These Terms of Service govern your use of Montivue Optics and purchases made through montivueoptics.com. The store is operated by NAVAZZ GROUP LLC.

1. Acceptance

By accessing the website, creating an account, or placing an order, you agree to these terms and the policies referenced here. If you do not agree, do not use the store.

2. Eligibility and Accounts

You must be legally capable of entering a binding contract in your jurisdiction. You are responsible for accurate account information and for safeguarding login credentials. Notify us promptly of suspected unauthorized use.

3. Product Information and Eyewear Disclaimer

We aim to describe products, lens features, strengths, dimensions, colors, materials, and included items accurately. Appearance may vary by display and production batch. Review each product page before ordering.

Montivue Optics is an online retailer, not an optometry clinic or healthcare provider. Ready-made glasses and educational guides do not replace a professional eye examination, diagnosis, or individual prescription. Seek qualified eye care for sudden vision changes, pain, double vision, persistent headaches, significant visual difficulty, or other concerning symptoms.

4. Prices, Currencies, Taxes, and Promotions

Prices, discounts, currencies, shipping charges, and taxes may change without notice before an order is placed. Currency conversions shown by a browser, bank, wallet, or payment provider may differ from checkout. Promotions are subject to their stated conditions, availability, and lawful modification or cancellation.

5. Orders and Acceptance

An order confirmation acknowledges receipt but does not necessarily constitute final acceptance. We may verify payment, address, fraud risk, inventory, quantity, and pricing. We may reject or cancel an order for legitimate reasons, including suspected fraud, unavailable inventory, obvious errors, resale abuse, or legal restrictions. Any amount captured for a canceled order will be refunded as required.

6. Payment

You authorize the selected payment provider to charge the total shown at checkout. Payment services are governed by their own terms. Do not submit payment information you are not authorized to use.

7. Shipping and Delivery

Processing, estimates, tracking, customs, and delivery responsibilities are described in our Shipping Policy. Risk and title transfer according to applicable law and the delivery method used.

8. Returns and Refunds

Returns, exchanges, defects, refunds, and cancellation requests are governed by our Return and Refund Policy and any mandatory consumer rights. Do not send a return without written authorization.

9. Acceptable Use

You may not use the store to violate law; infringe rights; transmit malicious code; scrape or interfere with systems; evade security; submit false information; impersonate another person; commit fraud; or place orders for unauthorized resale or abusive purposes.

10. Intellectual Property

The Montivue Optics brand, original store content, photographs, graphics, software, and design elements are owned by or licensed to NAVAZZ GROUP LLC and protected by applicable law. Limited personal use of the website does not transfer ownership or grant commercial rights.

11. Reviews and Submissions

If you submit a review, photograph, suggestion, or other content, you confirm that you have the necessary rights and that the content is lawful and accurate. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, and display it for operating and promoting the store, subject to applicable privacy law.

12. Third-Party Services and Links

Shopify, payment providers, carriers, fulfillment partners, and other third parties may provide parts of the service. We are not responsible for independent third-party websites, content, or policies, except where applicable law provides otherwise.

13. Disclaimer

To the maximum extent permitted by law, the website and general informational content are provided on an “as available” basis. We do not promise uninterrupted access or that every non-material error will be corrected immediately. This disclaimer does not affect product guarantees or rights that cannot be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, NAVAZZ GROUP LLC and its service providers are not liable for indirect, incidental, special, punitive, or consequential loss arising from use of the store. Nothing excludes liability for fraud, willful misconduct, personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be limited.

15. Indemnity

Where permitted by law, you agree to indemnify NAVAZZ GROUP LLC against losses arising from your unlawful misuse of the store, infringement of third-party rights, or material breach of these terms.

16. Suspension and Termination

We may restrict access or cancel abusive or fraudulent activity when reasonably necessary to protect customers, systems, service providers, or legal rights.

17. Severability and No Waiver

If any provision is unenforceable, the remaining provisions remain effective to the extent allowed. Failure to enforce a provision once is not a permanent waiver.

19. Governing Law

Except where mandatory consumer law provides otherwise, these terms are governed by the laws of the State of New Mexico and applicable federal law of the United States. A consumer may retain the protection and forum rights provided by mandatory law in the consumer’s place of residence.
